1. EVERYTHING MUST BE PAID IN FULL ON THE DAY OF THE AUCTION. NO EXCEPTIONS. This shall remain true regardless of when item or items will be picked up. Payment for purchases to be made by cash or cashier's check; a company or personal check MUST be accompanied by bank letter of guarantee from said bank addressed to JWA for this particular sale and presented at check in - NO EXCEPTIONS. All checks must be made payable to Johnny Wright Auctions, LLC. JWA IS NOT RESPONSIBLE FOR BAD CHECKS, CHARGE BACKS, AND UNPAID AUCTION ITEMS. Buyers using credit/debit cards will be charged an additional 3.5% convenience fee.
2. NO ITEMS SHALL BE SOLD PRIOR TO OR WITHDRAWN FROM THE AUCTION EXCEPT BY MUTUAL AGREEMENT OF THE SELLER AND AUCTIONEER.
3. Buyer's premium will be collected and retained by JWA in addition to Seller Fees.
4. All sales are subject to the sales tax laws of the state of Mississippi.
5. Tax exempt Bidders using resale tax ID MUST present a paper copy of certificate at check in, with the name and contact info written on copy that matches the name of the registered bidder. NO EXCEPTIONS.
6. Everything shall be sold "as is, where is". There shall be no guarantees made of any kind, regardless of any statement of condition that may be made from any auction staff, both verbal and written. Bidder shall be responsible for his/her own inspection and information and shall rely solely on such.
7. Every effort will be made to "protect" items throughout the auction; however, each Bidder becomes solely and entirely responsible for all items purchased by him/her immediately following a winning bid. Therefore, Bidder is advised to further protect items at Bidder's discretion.
8. It is Bidder's responsibility to know which item he/she is bidding on. If unsure, Bidder should inquire about item or not bid. Becoming a winning Bidder means that you have effected a contract between you and the Seller and you will be expected to pay for all items for which you are evidenced to be the winning Bidder. Auctioneer will not honor "mistakes". The Auctioneer shall designate the buyer after each item is auctioned. If there is a dispute between two or more Bidders, the Auctioneer has the right to reopen bidding. The Auctioneer’s designation of buyer shall be final.
9. The Auctioneer reserves the right to accept any bids in any increment that, in the Auctioneer's opinion, are in the best interest of his client, the Seller. The Auctioneer also reserves the right to reject the bid of any Bidder whose conduct, adverse comments, or actions the Auctioneer feels are not in the best interest of the Seller.
10. There is a 10% buyer's premium applied to the first $5000 of each lot and then a 2% buyer's premium applied to the remaining balance of each lot.
11. No purchased items may be removed from site until after the auction is over. A copy of the paid receipt must be presented to sales staff before loading out. Sales staff will assist with loading purchased items, but it is the SOLE RESPONSIBILITY of the buyer to make sure items are loaded and secured to his/her satisfaction.
12. All vehicles MUST HAVE an open title presented at check in or a bank letter showing current payoff. NO EXCEPTIONS
13. All Sellers and Bidders agree to the above Terms & Conditions upon consigning an item or signing up for a Bidder number.
14. JWA is not responsible for discrepancies or errors in advertising.
15. It is the buyers responsibility to inspect the items before bidding. JWA will provide a designated time for inspection.
16. If you are the high bidder you are liable to pay the purchase price including any and all fees plus sales tax.
17. Effective July 1, 2008, all Mississippi motorcycle and all-terrain vehicle retailers are required to collect the Motorcycle/ATV Trauma Care Fee of $50.00 on every retail sale of a new or used motorcycle or all-terrain vehicle, even if the purchaser is an exempt entity. The Motorcycle/ATV Trauma Care Fee is in addition to the regular 7% sales tax collected on retail sales of motorcycles and ATVs. The $50.00 Motorcycle/ATV Trauma Care Fee is not subject to the regular 7% sales tax. THIS FEE IS COLLECTED THE DAY OF THE SALE. 18. To receive the MS Farmers reduced sales tax, a copy of the state issued certificate must be presented at check in.
19. We do not accept tires and household items into our auction.
